CITY FILES RESPONSE TO SHIPMAN'S MOTION TO DISMISS LAWSUIT

(Richmond, IN)--On the last day they could, private attorneys representing the city of Richmond and Adam Blanton filed a response to Wayne County Prosecutor Mike Shipman’s motion to dismiss the city and Blanton’s lawsuit against Shipman for Blanton’s placement on the Brady List last year.  In a five-part, 21-page response, the city’s attorneys claim the lawsuit should not be dismissed essentially because Shipman knew that Blanton was an administrative officer and was unlikely to testify in a criminal case.  It also claims Blanton was not given due process.  There is no timeline listed for a judge to decide whether the case should be dismissed or not.  The city had already spent in excess of $37,000 in legal fees before the time spent by the private law firm to draft this week’s response.
