JUDGE DISMISSES BLANTON, CITY'S LAWSUIT AGAINST SHIPMAN

(Richmond, IN)--A judge has dismissed the lawsuit filed by Richmond Police Department Assistant Chief Adam Blanton and the City of Richmond against Wayne County Prosecutor Mike Shipman.  The lawsuit was based on Blanton’s placement on the Brady List last year as a result of inaccurate public statements made by Blanton.  The primary inaccuracy claimed that a murder victim was not a confidential informant when, in fact, that person was an informant.  In the complaint, Blanton did not deny his statements were inaccurate but said that they were "minor inaccuracies."  In his decision, which was filed Monday, Special Judge Bob Witham wrote that Shipman’s placement of Blanton on the Brady List "falls squarely within the execution of the duties of his office" and that absolute immunity shields Shipman.  The city has spent in excess of $100,000 in legal fees since joining the lawsuit which, again, has now been dismissed.
